What is H&C?

H&C stands for Humanitarian and compassionate. It is an application for permanent residence in Canada. Typically, H&C should be the last effort to stay in Canada.

If you have children, include letters of recommendation for your children in your H&C application. School counselors, community health workers, family doctors, teachers, social workers or psychologists can write letters to your children concerning the detrimental emotional and physical impacts of returning to your home country.

Based on whether or not your children were born in Canada, whether or not they attended(ed) school in Canada, and whether or not they have ever visited your home country, the officer will decide how close their ties to Canada are.

Who is eligible for H&C?

People usually apply for H&C for two main reasons: hardship and risk. You can submit a request in Canada or Overseas.

  • Hardship refers to a circumstance that would give you significant problems or suffering. You would endure hardship if you were forced to leave Canada and return to your home country, you may choose to apply for H&C.
  • Risk means that there is a high probability any of the following might happen to you if you are forced to leave Canada for your home country. You must demonstrate that you are exposed to one or more of these risks.

The following reasons and information will make your case for staying in Canada weaker:

  • Your ties to Canada are based mainly on having worked here and paid taxes
  • You have been on welfare for most of your time in Canada
  • You have a criminal record
